Ordinance Enforcement

Ordinance ViolationsSpringport Township's Ordinance Enforcement Officer focuses on the prevention, reduction and elimination of environmental blight and its underlying causes. This type of ordinance enforcement strategy directly supports the community policing philosophy by reducing or eliminating environmental factors that contribute to crime and disorder.

Miscellaneous Rubbish

The Rubbish Ordinance is designed to prevent, reduce or eliminate certain environmental causes of rubbish or blighting factors which exist or may exist in the township in the future. The following is a summary of uses, structures and activities that have been determined to be causes of blight and contribute to undesirable neighborhoods:

·         Storage of building materials outside of an enclosed structure or fenced area, without a building permit for the property.

·         Storage of accumulated litter, junk, trash, rubbish, refuse, waste materials, garbage, and other debris.

·         Storage of parts of machinery, parts of motor vehicles and unused appliances in the open.

·         Existence of uninhabitable structures due to fire, wind or other natural disaster or physical deterioration.

·         Existence of vacant dwellings, garages or accessory buildings that are not securely locked.

·         Existence of partially completed and abandoned structures.

 

Nonoperating Vehicles

The Nonoperating Motor Vehicle Ordinance is designed to promote the health, safety and welfare of residents and property owners. Non-operating vehicles are a hazardous attraction for children and others, tend to devaluate property values, and contribute to the presence of crime and disorder.

·         It is unlawful to park or store inoperable, wrecked, junked or partially dismantled motor vehicles on any street, public or residential property, unless wholly contained in a fully enclosed building.

Noise

Unreasonably loud, disturbing or unnecessary noise contributes to the deterioration of neighborhoods and business districts and destroys the peace and tranquility of the township. In many cases, the source of loud noise is a mobile "boom box" device installed in cars and trucks to play music.

·         It is unlawful for any person himself, or knowingly to permit another person in any place owned and/or controlled by him, to create, assist in creating, permit or continue any unreasonably loud, disturbing, or unnecessary noise, which injures or endangers the comfort, health, peace or safety of others.

·         The sounding of any horn or sounding device from a motor vehicle, except as a danger signal, is considered unreasonable.

·         The playing of any sound reproduction device from a motor vehicle in a manner as to be plainly audible in any dwelling or on public property within 50 feet of the vehicle.

·         The registered owner of a motor vehicle is presumed to be responsible for noise violations

       

Penalties:

If a violation has occurred a written or verbal 30 notice will be issued to the property owner. If the violation has not been corrected within the 30 period a written citation shall be issued for the amount of a minimum of $100.00 and up to $500.00 fine. If being cited for miscellaneous rubbish, the Township may remove it and the property owner SHALL be billed for the expense of the removal.
